California AB 1825 Frequently Asked Questions
How Does Web-Based Training Work?
Training Advisor’s Online AB 1825 Course is available 24 hours a day and can be accessed with a valid login from any computer with an internet connection. The course, which contains eleven sections, can be completed at each trainee’s own pace and provides interactive instruction that covers the requirements mandated by AB 1825.
Who Must Complete the Training?
Supervisors who work for any business or enterprise in California that employs 50 or more full-time, part-time, or temporary employees must complete the mandatory two-hour training every two years.
What Constitutes a Supervisor?
The California Fair Employment and Housing Act (FEHA) defines a supervisor as any employee that has the authority to “hire, transfer, suspend, layoff, recall, promote, discharge, assign, reward or discipline other employees, or the responsibility to direct them…if the exercise of that authority is not of a merely routine or clerical nature, but requires the use of independent judgment.” Some supervisory employees may not have the terms “supervisor” or “manager” in their title but are still required to complete the training.
How Often Must Supervisors Be Trained as Required by AB 1825?
In short, every two years. However, since employers are required to track and document each supervisor’s compliance, they can choose between two different tracking methods specified under AB 1825:
- Training Year Tracking - Employers can designate a training year in which they train all or a portion of their supervisors at the same time. Training must be completed again two years later in the next designated training year.
- Individual Tracking – Employers can track a supervisor’s training requirements individually from the date each supervisor completed their previous training.
